Dalton v. Republic Lloyds

Court: Tx 7-Amarillo  11/29/2023  Court Reverses Summary Judgment for Insurer and Remands to Determine if an Appraisal Award was Based on a Mistake of Fact

The Court rejected the insurer's contention that the summary judgment in its favor was proper because the uncontroverted evidence established that the insurer had paid significantly more than the amount of damages awarded by the appraisers because the insurer had failed to negate the insured's evidence that at least one of the appraisers had failed to include certain costs and expenses in his damage award.
