Court: Tx 9-Beaumont  05/23/2024  Court Affirms Award of Attorney's Fees in Dispute Arising Out of UIM Payment

The court rejected the insurer's argument that the trial court had abused its discretion by awarding attorney's fees under the Declaratory Judgment Act as the award was not equitable and just since the insured could have settled with the insurer early on in the litigation for more money than the insured was ultimately awarded at trial.
