A court of the Northern District of Texas granted an insurer and plan administrator's motion to dismiss an alleged beneficiary's action for damages stemming from a plan administrator's alleged failure to give required statutory notice of life insurance policy conversion options under COBRA, finding that plaintiff did not adequately allege what portions of the provided notice were not "written in a manner calculated to be understood by the average plan participant."
