A court of the Northern District of Texas overruled an insurer's objections and adopted a magistrates recommended resolution of cross-motions for summary judgment in a commercial hail damage dispute, granting the insured's motion in part but denying the insurer's motion while finding that the corrected appraisal award is binding, that a fact issue remains under the concurrent causation doctrine, and that fact issues prevent judgment on the insurer's bona fide dispute defense.
