A court of the Northern District of Texas granted a commercial property insurer’s motion for partial summary judgment on abandoned claims, bona fide dispute, and no evidence grounds, dismissing the insured’s DTPA, common law bad faith, and related Chapter 541 claims, but denying the insurer’s motion to strike the insured’s expert on damages and causation, and also granting the insured’s motion for partial summary judgment on the insurer’s pleaded exclusions, concurrent causation, and insufficiently pled conditions precedent.
