A court of the Northern District of Texas denied an insurers’ motion to dismiss on forum non conveniens grounds or to stay on abstention grounds in a coverage suit against 83 liability insurers filed by a settlement trustee, finding that dismissal is not warranted because the insurers had not met their burden to show that the proposed forum, an Illinois state court, is available and that abstention is not warranted because the Illinois action is not parallel.
