Court: ND Tx  01/04/2024  Court Denies Insurer's Motions to Find Experts Unreliable and for Summary Judgment

A court of the Northern District of Texas adopted a magistrate's recommendation to resolve multiple motions filed by an insurer in a storm damage dispute, finding that the insurer's motion for summary judgment should be denied because the insured presented evidence segregating damages and that two motions to exclude experts should be denied outright but that a third motion to exclude should only be granted in part to the extent that certain rebuttal opinions were not timely disclosed.
