A court of the Eastern District of Texas granted in part a health insurer’s motion to compel disclosure of a health care provider’s out-of-pocket costs and billing methodology in a suit to recover emergency care costs for out-of-network patients, holding that administrative history and statutory language support the relevance of the billing information, prior judicial interpretation of the “usual and customary” statute supports a finding of relevance, and that the provider’s own expert had placed the billing information within the scope of relevancy.
