A court of the Northern District of Texas denied an insured’s “no evidence” motion for summary judgment and granted in part an insurer’s motion for summary judgment, holding that the insured’s extra-contractual claims for common law bad faith, DTPA, and Chapter 541 violations must be dismissed where the record showed a mere bona fide dispute, but that the insured’s “no evidence” motion must be denied because federal courts do not recognize such a motion.
