A court of the Northern District of Texas accepted a magistrate’s recommendation to grant an insurer’s motion for summary judgment seeking enforcement of and specific performance under a settlement agreement, finding that where the insureds’ counsel had authority to accept and did accept the insurer’s settlement offer, but where the insureds refused to sign a full and final release, an enforceable contract had been formed and specific performance is the appropriate remedy.
