A court of the Southern District of Texas denied an insured’s motion to substitute its previously selected but unpaid appraiser for lack of legal foundation, denied the insured’s motion to compel appraisal of lost rents because the opposed motion failed to comply with the court’s conferral requirements, but granted the insured’s motion to abate the lawsuit pending completion of the property appraisal.
