A court of the Northern District of Texas granted an ERISA plan administrator's motion to dismiss an out-of-network air ambulance service provider's action to enforce an Independent Dispute Resolution award under the No Surprises Act, holding that the No Surprises Act does not provide for an express or implied private cause of action and that the providers lack standing under ERISA.
