A court of the Northern District of Texas resolved cross-motions for summary judgment in a storm damage dispute, denying summary judgment for the insurer on breach of contract, granting partial summary judgment for the insurer on certain extra-contractual claims that presented a mere bona fide dispute, denying summary judgment to the insured on extra-contractual claims, denying summary judgment to the insurer on TPPCA claims, and also denying the insurer’s motion to strike Plaintiff’s non-retained experts due to a lack of prejudice flowing from the insured’s failure to properly disclose.
