The appellate court held that the trial court abused its discretion by appointing an umpire when policy required the appointment of an umpire to be made by the AAA and the fact that the insured inadvertently attached the wrong insurance policy which, unlike the correct policy, allowed the parties to ask a judge to select an empire, did not change this result.
