A court of the Northern District of Texas granted in part an insurer’s motion for summary judgment under a contractually-shortened limitations period, holding that the insurer’s post-appraisal denial of the claim was not inconsistent with its prior denial and, therefore, did not establish a new accrual date of the limitations period, but that the insured’s fraud claims are subject to a four-year limitation period and not subject to dismissal.
