Publish Date

The Fifth Circuit Court of Appeals reversed judgment and remanded in a life insurer’s interpleader action, finding that the presiding magistrate erred when interpreting the word “received” under the Federal Employees’ Group Life Insurance Act and holding that the term does not require that the beneficiary designation form bear some indicia of receipt, thus requiring resolution of a fact issue as to whether the beneficiary designation form was actually received as alleged.
