The Fifth Circuit Court of Appeals affirmed summary judgment granted by district court in favor of beneficiaries designated by insured and by her power of attorney from hospital room, finding the insured made affirmative steps to designate beneficiaries and plan’s default provisions did not apply to provide insured’s sisters beneficiary status.
