A court of the Western District of Texas granted an insurer’s Rule 12(b)(6) motion to dismiss in a dispute involving an insured under an ERISA-governed health benefits plan, holding that claims alleging failure to provide plan documents and breach of fiduciary duty failed because the insurer and a pharmacy benefit manager were not the plan administrator responsible for furnishing documents and because an ERISA § 1132(a)(3) fiduciary-duty claim is unavailable where the insured has an adequate remedy through a benefits claim under § 1132(a)(1).
