A court of the Eastern District of Texas adopted a magistrate’s recommendation to grant an insured’s and a non-diverse defendant’s motions to remand, finding that non-diverse defendants who were joined under the Texas Declaratory Judgment Act’s requirement to join “persons who have or claim any interest that would be affected by the declaration” were not improperly joined.
