A court of the Western District of Texas accepted a magistrate's recommendation to deny an insurer’s motion for summary judgment, finding that the case did not present a bona fide dispute where the insurer denied a roof hail claim on the basis that the damage allegedly occurred prior to the 2021 date of loss and in 2016, but where the insured presented uncontested evidence that the roof had actually been replaced in 2017.
