A court of the Northern District of Texas dismissed without prejudice an insured’s suit against an insurer arising from a property loss claim, accepting a magistrate’s recommendation and finding that the court lacked subject-matter jurisdiction because complete diversity was absent due to a non-diverse defendant and no federal question was presented, and further that amendment of jurisdictional allegations would be futile and severance of the non-diverse party was improper because that party was essential to the action.
