A court of the Southern District of Texas granted in part an insurer’s motion for summary judgment, finding that the record showed a mere bona fide dispute as to the insured’s DTPA, Chapter 541, and good faith and fair dealing claims, but that fact issues precluded dismissal of the insured’s contract and Prompt Payment of Claims Act claims where the record showed a “battle of the experts.”
