Texas Windstorm Insurance Association v. Pruski

Court: Tx Sup  05/10/2024  Supreme Court Reverses and Remands to Appellate Court in Dispute Over Validity of Judgment in Claim Against TWIA

The Supreme Court concluded that even though a district court judge should not have presided over a lawsuit against the Texas Windstorm Insurance Association because she was not appointed to hear the case in compliance with certain mandatory provisions of the Texas Insurance Code, the subsequent judgment was not void because the Insurance Code provisions did not include any language that deprived a court of subject matter jurisdiction if the proper procedures were not followed.
