A court for the Southern District of Texas denied in part an insurer’s motion for summary judgment on homeowner’s claims for breach of contract and alleged violations of the DTPA and Texas Insurance Code, holding dueling expert opinions presented a triable issue of fact, and granting in part the insurer’s motion for summary judgment on the homeowner’s unsupported fraud claim.
