A magistrate of the Eastern District of Texas recommended the denial of an insurer’s motion for summary judgment, holding that the insured presented sufficient evidence that would allow a jury to segregate covered from non-covered perils and that a fact issue remained as to whether the dispute presented a mere bona fide dispute.
