Homeland Insurance Co. of New York v. Clinical Pathology Laboratories, Inc.

Court: WD Tx  04/26/2021  Insurer's Claims Against Foreign Insureds Dismissed for Lack of Jurisdiction

A court of the Western District of Texas granted the insureds' motion to dismiss all claims against Irish insureds based on lack of specific personal jurisdiction over the Irish insureds in Texas, where policy would not be performed in Texas and foreign insureds' acts did not establish sufficient contacts with Texas, and further dismissed insurer's claims against domestic insureds for negligent misrepresentation, breach of warranty and for reformation under Fed. R. Civ. Proc. 12(b)(6).
